Terms of Use & Liability Disclaimer

Effective Date: October 2026

1. Acceptance of Terms

Accessing and utilizing Lumist Studio ("Lumist", "we", "our") constitutes your agreement to be bound by these terms. If you disagree with any portion of these provisions, discontinue use of the utilities immediately.

2. Local-First Architecture & Data Responsibility

Critical Notice: Browser-Sandboxed Storage

Lumist Studio operates strictly on client-side storage. 100% of your data (sprint tasks, billable hours, code snippets, color palettes, and shadows) resides in your personal browser's IndexedDB sandbox.

We do not host, store, or back up your data on remote servers.

Clearing browser cache, cookies, or site data—or utilizing privacy extensions that automatically purge storage on tab closure—permanently deletes your local databases. You are solely responsible for creating routine backups using Lumist Safe or manual JSON exports.

3. Limitation of Liability

Lumist Studio, its creators, and engineering partners shall not be held liable for direct, indirect, incidental, consequential, special, or exemplary damages resulting from software use.

This exclusion applies to loss of data, loss of business revenue, missed client invoicing, or equipment downtime stemming from browser storage evictions, device failure, or local cache purges.

4. "As Is" Software Provision

The 15 utilities within Lumist Studio are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

5. Financial & Invoicing Disclaimer

Lumist Tally provides mathematical aggregations of your recorded hours to assist with client deliverables. Lumist is not an accounting firm, certified billing auditor, or tax advisory engine. You remain solely responsible for validating your timesheets, verifying hourly billing rates, and maintaining compliance with local tax and commercial regulations.
